To sell fast in Atlanta before foreclosure, get a written payoff, then compare a listing, a direct cash offer, an iBuyer offer, and a short sale. In Georgia, a licensed attorney must handle the closing. A cash sale with clear title can often close in one to three weeks, before the first-Tuesday courthouse sale.
Behind on payments or facing an auction? We buy houses in any condition, can stop the sale, and close on your timeline.

When a foreclosure ad with your address runs in the paper, it can feel like everyone knows and time is gone. You still own your home until the sale, and a careful choice now can protect the money you have in it.
You generally have until the first-Tuesday sale named in your 30-day notice and newspaper ad, because a sale that closes first pays off the loan and ends the foreclosure.
Quick facts for Atlanta sellers:
Most of Atlanta is in Fulton County, and part of the east side is in DeKalb. Check your tax bill. Our Atlanta foreclosure help guide covers each county's sale in detail.
Atlanta sellers usually weigh four paths: an agent listing, a direct cash buyer, an iBuyer, or a short sale.
This usually brings the most money, but a financed buyer needs an appraisal and loan approval, which commonly takes a month or more after a contract.
The buyer pays from its own funds and buys as-is, so timing mostly depends on the closing attorney's title work. You trade some price for speed. We are one direct cash buyer serving metro Atlanta; compare any offer, including ours, with at least one other.
Large iBuyer programs list the Atlanta metro as a service area (checked September 2026). They tend to buy newer homes in good shape and subtract fees and repairs.
If you owe more than the home is worth, your lender may accept less. Approval often takes months, and the lender may not delay the sale. See short sale vs. foreclosure.
| Agent listing | Direct cash buyer | iBuyer | Short sale | |
|---|---|---|---|---|
| Usual time to close | Weeks to find a buyer, then about a month for a loan | About 1–3 weeks with clear title | A few weeks | Often several months |
| Price | Closest to market | Below market | Near market, minus fees and repairs | Set by the lender |
| Condition | Repairs often requested | As-is | Repairs deducted; may decline | Usually as-is |
| Realistic once the ad is running? | Rarely | Sometimes | Rarely | Rarely |
| Works if underwater? | Only if you cover the gap | Only if you cover the gap | Only if you cover the gap | Yes |
In Georgia, a closing attorney, not just a title company, runs the closing: the attorney's office searches title, prepares the deed, collects the buyer's funds, pays off your loans and liens, and pays you the rest.
The closing attorney is usually chosen by the buyer and may not represent you. You can hire your own Georgia attorney to review the contract. You can confirm any attorney is a State Bar of Georgia member through the Bar's online member directory.
To get a payoff quote, send your servicer a written request with your loan number and a "good through" date a few days after your planned closing, and sign an authorization so the closing attorney can request it too. Ask about any second mortgage, HOA lien, or unpaid Fulton or DeKalb property taxes. Georgia also charges a transfer tax of $1 per $1,000 of the price (O.C.G.A. §48-6-1), which sellers often pay depending on the contract.
Most Atlanta investors start with the after-repair value (ARV) and subtract repairs, holding costs, resale costs, and profit.
A common rule of thumb is the "70% rule": offer = (ARV × 0.70) − repair costs. A home worth $300,000 after repairs that needs $45,000 in work would draw about $165,000 under that formula. Buyers who plan to keep the home as a rental, or homes needing little work, may get higher offers.
Ask each buyer to show the ARV, repair list, and costs behind the number. Then subtract your payoff, liens, and transfer tax to see what you would actually receive.
Look the company up with the Georgia Secretary of State, confirm who the closing attorney is, and ask whether your contract will be assigned.
The clearest red flag is a request to sign your deed or pay a fee anywhere other than a Georgia attorney's closing.

Only a buyer with funds ready and a closing attorney already working on title can usually close in time. Ask the loan contact named in your 30-day letter, in writing, whether it will postpone for a signed contract. Call Atlanta Legal Aid's Home Defense Program at (770) 817-7538 or a bankruptcy attorney today. Georgia has no general right to buy the home back after the sale.
A cash sale only works if you can cover the gap. A short sale or deed in lieu may be better; see underwater mortgage options.
The closing attorney will need proof of who can sign, often through probate court. Heirs may all need to sign. See inherited a home you can't afford.
Get two or more as-is offers and compare the repair estimates line by line.

Many are, but check proof of funds, earnest money, and the closing attorney before you sign. Never sign over your deed or pay a fee outside an attorney-run closing.
