Payoff and reinstatement describe different objectives. A payoff is intended to satisfy the mortgage obligation in full. Reinstatement, when available under the loan documents and applicable law, addresses the default so the loan can continue. Before a Houston foreclosure sale, ask for the right statement and confirm the requirements for using it.

Which figure do you need?

If a buyer is purchasing your home and the mortgage is to be released through closing, escrow generally needs a current payoff statement. If you intend to keep the property and bring the loan current, discuss reinstatement with the servicer and your lawyer. Do not assume the lender must accept overdue installments after acceleration without reviewing the governing terms.

A monthly statement balance is not a substitute for either calculation. Ask whether the requested figure includes interest, late charges, foreclosure expenses, and other amounts claimed. If a charge is disputed, preserve the statement and raise the issue promptly with counsel. Avoid guessing a smaller amount and assuming that sending it will resolve the sale.

What the federal payoff rule says

Regulation Z Section 1026.36(c)(3), for covered transactions, requires an accurate payoff statement within a reasonable time, ordinarily no more than seven business days after a written request. When foreclosure, bankruptcy, or other specified circumstances prevent that response, the rule provides a reasonable-time exception. Reasonable authorization and request procedures also matter. This does not create a seven-day foreclosure postponement. Read the CFPB rule and official interpretation.

Authorize the person requesting information

Ask the servicer which authorization it requires for your escrow officer or attorney. Submit it through the designated channel and keep proof of delivery. Confirm that the property, borrower name, account reference, and requested payment date are correct. If you inherited the property, disclose that immediately so the servicer can explain its identity and successor documentation process.

Keep sensitive loan information out of public forms and broad email chains. A buyer may need enough information to assess feasibility, but the authorized closing professionals should coordinate private account records through appropriate channels.

Check the statement before setting the closing

  • Does it identify the correct loan and recipient?
  • What date is the amount valid through?
  • How are additional days or changed expenses handled?
  • What payment method and reference information are required?
  • Who confirms receipt and application?
  • What separate communication confirms foreclosure status?

Ask escrow to explain the difference between receiving buyer funds, sending the payoff, and completing the remaining closing work. If the proposed closing date changes, obtain confirmation that the statement and instructions remain usable. A “good-through” date is an amount-validity term; do not assume it is permission to wait until then regardless of an earlier auction.

Use the figures to test your net proceeds

Write down the purchase price, mortgage payoff, other liens, taxes, and seller-paid costs. The resulting estimate helps show whether the sale can close with available money. If the proceeds are insufficient, tell the title company and lawyer immediately. A buyer’s willingness to purchase does not resolve a lienholder’s shortfall or establish approval for a short sale.

For an illustration, suppose an offer leaves only a small margin after the estimated mortgage balance. Updated foreclosure costs or a second lien could use that margin. The right response is to obtain current figures and review the gap, rather than signing on the assumption that someone will negotiate it later.

Record completion, not just activity

Maintain a dated record of authorization, request delivery, statement receipt, updated instructions, payment transmission, and confirmation. Ask who owns the final sale-status check. If the process is stalled and the auction is close, consult counsel about available alternatives while the request remains pending.
