1. Engagement & Scope

You ("Client") engage National Home Support LLC ("NHS," "we," "us") as a non-attorney document preparation and filing service for the limited purpose of preparing and submitting an emergency federal court filing on Client's behalf, including but not limited to a petition under Title 11 of the United States Code (the federal Bankruptcy Code). NHS is not a law firm, does not employ licensed attorneys to represent Client, does not provide legal, financial, tax, credit, or accounting advice in any form, and does not represent Client in court or in any adversary proceeding, contested matter, motion practice, appeal, or 341 meeting. Client expressly acknowledges this and waives any claim premised on a contrary expectation, theory, or assumption.

2. Express Acknowledgment of Filing Type

Client expressly acknowledges and agrees that the "emergency filing" being prepared and submitted by NHS on Client's behalf is, and is understood by Client to be, a federal bankruptcy petition filed under Title 11 of the United States Code (typically Chapter 7 or Chapter 13). Client understands that the term "emergency filing" used by NHS in marketing, communications, and on its website refers to this bankruptcy petition. Client confirms that Client has been informed of this in writing through this agreement and that Client is making the decision to proceed with full knowledge that a federal bankruptcy filing will be made in Client's name. Client waives any claim, defense, or argument based on any assertion that Client did not know, did not understand, was not told, or was misled about the fact that the filing is a bankruptcy petition.

3. Independent Decision; No Reliance

Client confirms that the decision to engage NHS and to authorize this filing is Client's own informed, voluntary, and independent decision, made without reliance on any oral statement, advertisement, prediction, projection, marketing material, testimonial, social media post, or representation by NHS, its agents, employees, contractors, or affiliates regarding outcomes, success rates, credit effects, timing, refinance prospects, sale prospects, retention prospects, lender behavior, trustee behavior, or any other matter. Any general information NHS has provided is for informational purposes only and is not legal, financial, tax, accounting, credit, or real-estate advice. Client has had a full, fair, and reasonable opportunity to consult independent licensed counsel prior to signing and has either done so or knowingly elected not to do so, and Client proceeds with full understanding of the consequences.

4. Authority Granted to NHS

Client grants NHS broad, durable, and irrevocable authority for the duration of the engagement to: (a) prepare the filing and any related skeleton schedules, statements, certifications, declarations, exhibits, and supporting documents using information Client provides; (b) submit, file, and re-file the same to the appropriate United States Bankruptcy Court electronically (CM/ECF or otherwise) or in person; (c) deliver, drop off, pick up, courier, fax, mail, hand-file, e-file, transport, and process any related document at the courthouse, the office of the United States Trustee, the chapter trustee's office, the lender's office, lender's counsel's office, title company, escrow agent, or any related party; (d) communicate on Client's behalf with court clerks, trustees, lenders, lender counsel, title companies, and escrow agents on procedural and logistical matters; (e) receive filed-stamp copies, case numbers, notices, and routine correspondence; (f) take any reasonable action necessary to effectuate the filing and the services described in Client's selected package. This authority survives until the support window ends or Client revokes it in a signed writing personally delivered or mailed certified to NHS at its principal place of business.

5. Acknowledgment of Effects of a Bankruptcy Filing

Client understands and accepts, with full knowledge of each item, that the filing will: (a) create a public federal court record in Client's name searchable through PACER and other public databases; (b) appear on Client's consumer credit report and may significantly lower Client's credit score for a period of up to ten (10) years (Chapter 7) or seven (7) years (Chapter 13) from the date of filing; (c) impact future credit, financing, mortgage qualification, refinance prospects, rental and housing applications, insurance underwriting, and certain employment screenings, including positions requiring security clearances or fiduciary licensure; (d) require Client to attend a meeting of creditors under 11 U.S.C. § 341 and complete pre-petition credit counseling and pre-discharge debtor-education courses through approved providers; (e) require Client to surrender, restructure, repay, or reaffirm certain debts and may result in liquidation, sale, or trustee disposition of certain assets; (f) impose ongoing duties of disclosure, cooperation, and truthfulness to the court and the trustee; (g) potentially be dismissed, denied discharge, converted, or subject to sanctions if Client fails to comply with the Bankruptcy Code, Federal Rules of Bankruptcy Procedure, local rules, or court orders; (h) become a matter Client must disclose on future credit, mortgage, employment, and rental applications when asked. Client accepts each of these consequences in full, voluntarily, and waives any claim against NHS arising from any of them.

6. Information Accuracy; Federal Crimes Notice

Client warrants that all information Client has provided and will provide is true, complete, accurate, and not misleading. NHS performs no independent investigation or verification of Client's information and is entitled to rely fully and exclusively on Client's representations. Client understands that knowingly and fraudulently making a false statement, account, or claim in connection with a federal bankruptcy case is a crime under 18 U.S.C. § 152, that knowingly and fraudulently concealing assets is a crime under the same statute, that bankruptcy fraud is punishable by fine and imprisonment of up to five (5) years per count, and that the United States Trustee, the Department of Justice, and the Federal Bureau of Investigation actively investigate and prosecute such matters. NHS bears no liability whatsoever, civil or otherwise, for inaccurate, incomplete, false, fraudulent, or omitted information supplied by Client, and Client expressly indemnifies NHS for any consequence arising therefrom.

7. Payment Terms

The package fee is due in full before any work begins and is fully earned and non-refundable once preparation has commenced, regardless of case outcome, dismissal, voluntary withdrawal, conversion to another chapter, sanctions, denial of discharge, lift-stay relief granted to a creditor, refinance, sale, retention, or any other event or non-event affecting the property or the case. Court filing fees (currently approximately $338 for Chapter 7 and $313 for Chapter 13) are separate from package pricing, paid directly to the court, and not collected, advanced, or refunded by NHS unless expressly agreed in writing. For NHS Pre-Paid clients, Client irrevocably directs any title company, escrow agent, real-estate agent, attorney, or closing officer handling the property to pay NHS's balance from Client's funds at closing, refinance, settlement, or any other disposition before disbursing any net proceeds to Client, and authorizes NHS to record, deliver, and enforce this direction with the appropriate parties as a payoff demand.

8. Hold Harmless, Release, and Indemnification

Client hereby releases, indemnifies, defends, and holds harmless NHS, its members, owners, officers, directors, employees, independent contractors, agents, attorneys, affiliates, successors, and assigns from and against any and all claims, demands, causes of action, damages, losses, costs, expenses, attorney's fees, expert fees, judgments, settlements, fines, penalties, and liabilities of every kind and nature — known or unknown, anticipated or unanticipated, foreseen or unforeseen, present or future, asserted by Client or by any third party — arising from or related to: (a) the preparation, drafting, contents, accuracy, completeness, submission, filing, acceptance, rejection, dismissal, or conversion of the filing; (b) any direct or indirect consequence of the filing, including credit impact, public-record impact, dismissal, conversion, denial of discharge, sanctions, lift-stay orders, trustee actions, lender actions, creditor actions, and tax consequences; (c) any delay, error, omission, clerical mistake, technical failure, electronic-filing rejection, or rejection by any court clerk, trustee, lender, or third party; (d) any document delivery, courier activity, drop-off, pick-up, fax, mail, electronic communication, or other logistical activity undertaken on Client's behalf; (e) any information Client provided, failed to provide, withheld, misstated, or supplied inaccurately; (f) any decision Client made before, during, or after the engagement, including the decision to file, the decision not to file, the decision to withdraw, the decision to convert, and the decision to retain or release any property; (g) any claim by a spouse, co-borrower, co-owner, family member, lender, creditor, trustee, court, or governmental authority asserting that Client did not understand the nature or consequences of the filing.

9. Limitation of Liability

To the maximum extent permitted by law, NHS's total aggregate liability to Client for any and all claims arising under or related to this agreement, the engagement, the filing, or any service provided shall not, under any circumstance and on any theory of liability — whether in contract, tort, negligence, gross negligence (to the extent waivable under Texas law), strict liability, statute, restitution, or otherwise — exceed the amount Client has actually paid NHS under this agreement. NHS shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including without limitation lost profits, lost equity, loss of property, loss of housing, loss of opportunity, loss of credit, emotional distress, mental anguish, or reputational damage, even if NHS has been advised of the possibility of such damages. The limitations in this section reflect the bargained-for allocation of risk between the parties and survive termination of this agreement.

10. Collections

Unpaid balances may, at NHS's sole discretion, be referred to a licensed third-party collections agency; reported to consumer credit bureaus including but not limited to Equifax, Experian, and TransUnion; recovered through legal action in which Client shall be liable for all reasonable attorney's fees, court costs, expert fees, service of process fees, and recovery costs; and/or secured by a lien, claim, or charging order against the subject property and any proceeds of its sale, refinance, settlement, or transfer. Client expressly authorizes NHS and its agents, contractors, and assignees to contact Client by phone (including mobile and auto-dialed calls), mail, email, and SMS regarding any outstanding balance, and waives any claim under the Telephone Consumer Protection Act or analogous state law to the extent waivable.

11. Electronic Signature; Recordkeeping; Communications Consent

Client's typed name, drawn signature, IP address, browser fingerprint, and the timestamp captured at submission together constitute a valid, binding, and enforceable electronic signature under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. § 7001 et seq.) and applicable state Uniform Electronic Transactions Act, with the same legal force, effect, and admissibility as a wet-ink handwritten signature on paper. NHS may retain electronic copies of this agreement, the submitted form, the signature image, and all submission metadata indefinitely as a business record and may produce them in any legal proceeding without further authentication. Client consents to receive all communications, notices, disclosures, and records from NHS in electronic form.

12. No Guarantee of Outcome

NHS makes no representation, warranty, or guarantee — express, implied, or statutory — regarding the outcome of the filing, the granting or denial of an automatic stay, the success of stopping any auction or sale, the granting or denial of discharge, the timing of any court action, the response or behavior of any lender, creditor, trustee, or court, or the long-term financial outcome for Client. All such matters depend on factors outside NHS's control, including the discretion of judges, trustees, court clerks, opposing counsel, and Client's own continued compliance and cooperation.

13. Severability of Promotional Language

Any informal, promotional, marketing, or conversational language used by NHS or its representatives — including but not limited to terms such as "stop your auction," "save your home," "emergency filing," "pause your sale," or similar phrases — is descriptive only and does not constitute a guarantee, warranty, contractual promise, or representation of result. The terms of this written agreement supersede any such language and constitute the complete and final understanding between the parties.

14. Governing Law; Venue; Jury Waiver; Class Action Waiver

This agreement is governed by the laws of the State of Texas without regard to conflict-of-law principles. Any dispute, claim, or controversy arising under, related to, or in connection with this agreement, the engagement, or any service provided shall be brought exclusively in the state or federal courts located in Tarrant County, Texas, and Client irrevocably consents to personal jurisdiction and venue there and waives any objection based on inconvenient forum. The parties knowingly, voluntarily, and intentionally waive any right to a jury trial on any matter arising under or related to this agreement. Client further waives the right to participate in any class action, collective action, or representative action against NHS, and agrees that any claim shall be brought solely in Client's individual capacity.

15. Severability; Entire Agreement; Survival

If any provision of this agreement is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to render it enforceable while preserving the parties' original intent. This agreement, together with the submitted form, the signature, and any payment confirmation, constitutes the entire agreement between the parties and supersedes any prior oral, written, or electronic communication, advertisement, marketing material, or representation. Sections 5 through 14 survive termination, completion, or rescission of this agreement and remain enforceable indefinitely.
